These Terms & Conditions govern your use of AthleteBanner.com and any purchase of products or services from AthleteBanner.com. By accessing our website, creating a design, submitting artwork, placing an order, approving a proof, or completing a purchase, you agree to be bound by these Terms & Conditions.
Please review these terms carefully before placing an order. Because our products are custom-designed and made to order, additional restrictions apply compared with standard retail products.
Custom and Made-to-Order Products
All AthleteBanner products are custom-made specifically for the customer based on selected options, submitted information, uploaded photographs, uploaded artwork, team information, and/or approved designs.
Once production has begun, orders generally cannot be canceled, changed, returned, or exchanged. Custom products cannot normally be resold and are therefore subject to the policies described in our Refunds, Returns & Exchanges Policy.
Customer Responsibility for Order Information
Customers are responsible for carefully reviewing all information submitted before approving or purchasing a banner. This includes, but is not limited to:
- Player names
- Player numbers
- Team names
- School or organization names
- Banner size and orientation
- Photographs
- Logos
- Colors
- Spelling
- Additional wording or personalization
AthleteBanner.com is not responsible for errors contained in information supplied or approved by the customer.
If a banner is produced exactly as submitted or approved, the presence of a spelling error, incorrect number, incorrect photograph, incorrect logo, incorrect team information, or other customer-provided error does not qualify the product as defective.
Design Proofs and Customer Approval
When a design preview or proof is provided, it is the customer's responsibility to review the entire design before approving it.
Approval of a design indicates that the customer accepts the design as displayed, including the layout, photographs, text, spelling, player information, colors, logos, positioning, and overall appearance.
Once a design has been approved and submitted for production, changes may not be possible.
If changes are requested after approval, AthleteBanner.com may charge an additional design, production, or replacement fee depending on the status of the order.
AI-Assisted and Automated Designs
AthleteBanner.com may use automated design tools, artificial intelligence, image-processing technology, templates, or other software to assist in creating custom banner artwork.
Customers are responsible for reviewing the generated design before approval. Automated designs may include artistic interpretation, background effects, lighting changes, color adjustments, image enhancement, cropping, or other visual modifications.
Minor differences between a generated preview and the final printed product do not automatically constitute a defect.
Customer-Uploaded Photos and Artwork
Customers are responsible for providing photographs, logos, artwork, and other files of sufficient quality for printing.
Low-resolution, blurry, compressed, pixelated, dark, poorly cropped, or otherwise limited source images may affect final print quality.
When a customer chooses to proceed with an image after receiving a quality warning, the customer accepts responsibility for any resulting reduction in print quality.
AthleteBanner.com may attempt to improve or optimize customer-provided files, but we do not guarantee that low-quality source files can be fully corrected.
Rights to Uploaded Content
By uploading photographs, logos, graphics, trademarks, artwork, names, or other content to AthleteBanner.com, the customer represents and warrants that they own the content or have all necessary permission, authorization, or legal rights to use and reproduce that content.
The customer grants AthleteBanner.com permission to reproduce, modify, resize, crop, enhance, process, and print the submitted content as necessary to fulfill the order.
AthleteBanner.com is not responsible for determining ownership of customer-submitted content.
The customer agrees to indemnify and hold AthleteBanner.com harmless from claims arising from the unauthorized use of photographs, logos, trademarks, artwork, copyrighted material, or other submitted content.
School, Team, League, and Organization Logos
Customers submitting school, team, league, club, organization, or sponsor logos are responsible for obtaining any permission required to reproduce those logos.
Submission of a logo constitutes the customer's representation that they have permission to use it for the requested custom product.
Print Colors and Screen Colors
Colors displayed on phones, tablets, computer monitors, and other screens may differ from the colors produced during physical printing.
Differences may occur because of screen settings, display technology, lighting conditions, printing processes, fabric or vinyl characteristics, ink, materials, and color conversion.
Minor color variation between an on-screen preview and a printed banner is considered normal and does not qualify as a manufacturing defect.
Image Placement and Cropping
Some photographs or artwork may require cropping, resizing, repositioning, masking, or background removal to fit the selected banner size and design.
Minor differences in image placement, scaling, cropping, or spacing that result from production requirements are considered normal.
Banner Measurements
Banner sizes are described using approximate finished dimensions.
Minor variations may occur during cutting, hemming, finishing, sewing, grommet installation, or other manufacturing processes. Small production tolerances do not constitute a defect.
Production Times
Production estimates are estimates only and are not guaranteed completion dates.
Production may be delayed by artwork issues, customer revisions, missing information, supplier delays, equipment problems, high order volume, material availability, quality-control concerns, weather, shipping disruptions, or circumstances outside our reasonable control.
Orders requiring customer approval will not proceed until the required approval is received.
Shipping and Delivery
Shipping and delivery dates are estimates unless expressly stated otherwise in writing.
AthleteBanner.com is not responsible for delays caused by shipping carriers, weather, incorrect addresses, inaccessible delivery locations, carrier service interruptions, acts of nature, or other circumstances outside our control.
Customers are responsible for providing a complete and accurate shipping address.
Additional shipping charges resulting from an incorrect or incomplete address may be the responsibility of the customer.
Delivery Deadlines and Event Dates
Customers ordering banners for games, tournaments, senior nights, banquets, competitions, graduations, team events, or other time-sensitive occasions are responsible for placing orders with sufficient time for production and shipping.
Unless AthleteBanner.com expressly guarantees a delivery date in writing, failure of an order to arrive before a particular event does not automatically qualify the order for a refund.
Team Orders
Team orders may involve multiple players, designs, payments, photographs, names, numbers, and approvals.
The person creating or managing a team project is responsible for ensuring that information submitted for each participant is accurate.
If individual participants are permitted to submit information or payment separately, each participant remains responsible for the accuracy of the information associated with their individual banner.
AthleteBanner.com is not responsible for internal communication problems between coaches, parents, team managers, players, schools, clubs, or organizations.
Separate Payments for Team Orders
When AthleteBanner.com provides an option for team members or parents to pay separately, each transaction may be processed individually while remaining associated with a larger team project.
Payment by one participant does not obligate AthleteBanner.com to produce unpaid banners for other participants.
Production timing for a team project may depend on completion of required player information, artwork approval, and payment.
Pricing
Prices may vary based on banner size, quantity, selected options, shipping method, customization, production requirements, promotions, or other factors.
AthleteBanner.com reserves the right to correct pricing errors that occur because of technical errors, software errors, calculation errors, incorrect product configuration, or other unintended mistakes.
If a material pricing error is discovered after an order is placed, we may contact the customer before production begins to provide the corrected price or cancel and refund the affected order.
Coupons and Promotions
Discounts, promotional codes, coupons, and special offers may be subject to additional restrictions and may be modified or discontinued at any time unless otherwise required by law.
Discounts cannot normally be applied retroactively after an order has been completed.
Order Cancellation
Because AthleteBanner products are customized and made to order, cancellation rights are limited.
An order may only be canceled before design work, file preparation, manufacturing, or production has begun, unless AthleteBanner.com agrees otherwise.
If design work or other custom preparation has already been completed, cancellation may be denied or may be subject to a design or processing fee.
Refunds, Returns, and Exchanges
Custom products are subject to our Refunds, Returns & Exchanges Policy.
Except where required by law, AthleteBanner.com does not provide refunds or replacements for customer errors, change of mind, incorrect information supplied by the customer, approved design elements, minor color differences, minor production tolerances, or other characteristics consistent with an approved custom order.
Damaged or Incorrect Products
If an order arrives materially damaged, defective, or materially different from the approved order because of an error attributable to AthleteBanner.com or our production process, customers must contact us within the time period stated in our Refunds, Returns & Exchanges Policy.
Photographs of the product, packaging, shipping label, and affected area may be required before a claim can be reviewed.
Customers must retain the product and packaging until the claim has been resolved.
Chargebacks and Payment Disputes
Customers agree to contact AthleteBanner.com and allow us a reasonable opportunity to investigate and resolve an order-related issue before initiating a chargeback or payment dispute.
Submitting a chargeback does not automatically establish that a product was defective, unauthorized, or not delivered.
For payment disputes, AthleteBanner.com may provide the payment processor or financial institution with relevant transaction records, including order details, design approvals, uploaded content, account activity, correspondence, delivery confirmation, tracking information, website terms, and other records related to the transaction.
Fraudulent, abusive, or intentionally false chargeback claims may result in the customer's account being restricted or refused for future orders.
Fraud Prevention
AthleteBanner.com may use automated systems or manual review to identify potentially fraudulent or suspicious transactions.
We reserve the right to request additional verification, delay production, refuse an order, or cancel and refund a transaction when we reasonably believe additional verification is necessary.
Refusal of Service
AthleteBanner.com reserves the right to refuse or cancel an order when permitted by law, including orders involving suspected fraud, abusive behavior, unlawful content, intellectual-property concerns, threatening communications, repeated payment disputes, technical errors, or violations of these Terms & Conditions.
Prohibited Content
Customers may not submit content that is unlawful, fraudulent, defamatory, threatening, infringing, or otherwise prohibited by applicable law.
AthleteBanner.com may refuse to produce content that we reasonably believe violates applicable law or the rights of another person or organization.
Website Availability
We attempt to keep AthleteBanner.com and its design tools available and functioning properly, but uninterrupted service is not guaranteed.
The website may occasionally be unavailable because of maintenance, hosting issues, software updates, third-party outages, security concerns, internet disruptions, or other technical conditions.
Saved Projects
Where the website provides the ability to save projects, AthleteBanner.com does not guarantee that saved projects will remain available indefinitely.
Customers should not rely on AthleteBanner.com as their sole long-term storage location for original photographs, logos, artwork, or other files.
Intellectual Property
Except for customer-provided content, the AthleteBanner.com website, branding, software, graphics, layouts, design tools, templates, text, photographs, artwork, and other original materials are owned by or licensed to AthleteBanner.com and may not be copied, reproduced, redistributed, or commercially exploited without permission.
Design Ownership
Purchase of a finished banner does not automatically transfer ownership of AthleteBanner.com's underlying templates, editable design files, production files, software, design systems, or other proprietary materials.
Unless otherwise agreed in writing, customers purchase the finished custom product rather than the underlying editable production or design files.
Limitation of Liability
To the maximum extent permitted by applicable law, AthleteBanner.com will not be liable for indirect, incidental, consequential, special, punitive, or business-related damages arising from the use of our website, design tools, products, shipping services, or custom production services.
To the maximum extent permitted by applicable law, AthleteBanner.com's total liability relating to an individual order will not exceed the amount actually paid to AthleteBanner.com for the specific product giving rise to the claim.
Nothing in these Terms & Conditions excludes liability that cannot legally be excluded under applicable law.
Indemnification
To the extent permitted by law, customers agree to indemnify and hold AthleteBanner.com, its owners, affiliates, contractors, suppliers, and service providers harmless from claims, damages, losses, expenses, or liabilities arising from customer-submitted content, infringement claims, unlawful use of our services, or violations of these Terms & Conditions.
Third-Party Services
AthleteBanner.com may rely on third-party providers for services including payment processing, website hosting, shipping, printing, analytics, security, email, image processing, and other functions.
We are not responsible for outages, delays, errors, or service interruptions caused exclusively by third-party providers outside our reasonable control.
Changes to These Terms
AthleteBanner.com may update these Terms & Conditions periodically.
The version posted on the website at the time an order is placed will generally apply to that transaction unless applicable law requires otherwise.
Severability
If any provision of these Terms & Conditions is determined to be invalid, unenforceable, or unlawful, the remaining provisions will continue in effect to the fullest extent permitted by law.
Governing Law
These Terms & Conditions are governed by applicable federal law and the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
